1. This is in reference to my earlier email dated 8TH July 2005 pursuant to your letter dated 6th July 2005 . The previous email addressed on 8th July 2005 is annexed here with for your reference.

2. GTB has not collected documentary evidence at the time of appraisal and sanction of Rs 12.5 crores and at the time of creation of charge and hence Oriental Bank of Commerce (OBC) is not able to furnish detailed findings backed by documentary evidences inspite of e mails sent to them and copy of email sent to OBC was sent by email to Home Department as well as Crime Department.

3. I am referring a summary version of preamble as to why the matter falls under the provisions of INDIAN PENAL CODE as per Annexure 'A'.

4. I have sought opinion on various sections of Indian penal Code that can be made applicable to JATIN JALUNDHWALA , SUSHIL HANDA , MANAGEMENT OF GLOBAL TRUST BANK AND MANAGEMENT OF ORIENTAL BANK OF COMMERCE as per the explanation given below. This are primae facie sections and other additional sections of Indian Penal Codes would be also applicable too after collecting additional information. I am adducing the details as per ANNEXURE 'B' TO THE PRESENT E MAIL.


5. I would appreciate very much in case various detailed documentary evidences are collected by Shri J M Chaudhary from the management of Oriental Bank of Commerce and Jatin Jalundhwala.

6. I do hope that this preliminary information would suffice at this stage to initiate further necessary action in the matter and referred from time to time earlier.

7. Other persons and other section can be added at a later stage , once the detailed investigation findings are completed in light of letters sent to Shri Chaudhary earlier and attached herewith in form of file.

8. I have to once again reiterate that as I am exposing rogue Sushil Handa , it is necessary that the CRIME DEPARTMENT WOULD TAKE ALL PRECAUTIONARY MEASURES DURING INVESTIGATION TO PROTECT ME AS I AM INFORMANT CUM WHISTLEBLOWER AS MY LIFE CAN BE IN DANGER. I DO HOPE THAT YOU HAVE TAKEN THIS INTO CONSIDERATION THIS ASPECT.

ANNEXURE A:-


The methods employed by the parties fits into the definition of Section 23 of the IPC ( wrongful gain/wrongful loss) and Section 24 ( dishonestly) and Section 43 ( USING ILLEGAL MEANS).

1. Dhanyushya and Jalundhwala created charge on imoveable property in august 1998 and then issued notice to me and they did not disclose that the charge was created on the assets of rupmangalam and besides the contents of the notice made it abundantly clear that they did not have records of the company with them where by they could pass resolutions of in meetings. This showed that they had the intention of creating huge liabilities on the company first in collusion with the management of bank and wanted to use criminal threats and liablity scares to regularise illegal acts and cover up their illegal acts.

2. Jatin Jalundhwala wanted to cause wrongful loss to the shareholders of Rupmangalam and Flovin so that the legal share holders suffer a loss of assets of the company in guise of creation of charge.

3. Jatin Jalundhwala willfully and deliberately wanted to extend funds through Global Trust bank to loss making company called Core health care where Jatin Jalundhwala as employee of Core health care was fully aware that winding up petition was already filed against Core health care prior to the creation of charge on Rupmangalam and Flovin assets in august 1998. No sane person would have wanted to give funds to Core health care which would result in loss to the shareholders of Rupmangalm and Flovin. Besides , it would create wrong ful gain for Core Health care in form of funds flow through Global Trust Bank.

4. Sushil Handa as chairman and managing director of Core health care had borrowed interest bearing loan from Global Trust bank even when Core health care had given non interest bearing funds to Technology Finance where jatin jalundhwala and ameet desai were directors and Technology Finance was subsidiary of Core health care . Sushil handa would have refused generous offer of GTB and would have demanded funds back from Jatin jalundhwala and ameet desai of Technology Finance . Core health care and sushil handa did not have any explanation to offer when they gave reply through their advocate in February 2000 ashok d shah and a veiled threat was issued once again through their advocate.

5. Any sane banker would have refused loan to Core health care when they knew from the media as well as theri balance sheet the interest free loan was given by Core health care to Technology finance where jalundhwala and ameet desai were directors of Technology Finance and when american express had filed winding up petition. They could have inquired from all the bankers by writing to american express to find out the conduct of the account as part of due diligence exercise. . This clearly shows that the management of GTB had dishonest motive to cause loss to the share holders of Rupmangalam and share holders of GTB /common depostiors ,etc.

4.This showed basic dishonesty of jalundhwala , dhanyushaya , Core health care , sushil handa and management of GTB .

5. All of them even when they knew the situation and factual information , they conducted various illegal activities such as ( the under referred list doe not cover all other various illegal activities):-

Jalundhwala created charge on assets of Rupmangalam even when he had not furnished any documentary evidence that he continued as director after expiry of additional directorship.
Jalundhwala had created charge even when he was not able to justify that he had obtained approval of legal shareholders of rupmagalam and flovin.
Jalundhwala created charge on assets of Rupmanglam Investment Pvt Ltd by the Government of Gujarat.
Jalundhwala had shown in Dhanyushya that constructed portion of bunglow also belonged to Dhanyushya while creating the charge even when Rupmangalam exclusively owned constructed portion of bunglow and as per the provisions of 37I , this is illegal and void ab initio.
Rupmangalam was amalgamated into Span Medicals even when there was no confirmation from the escrow persons that they have parted the documents of ownership simultaneously from all mody family members and no written documentary evidence has been adduced by Jatin Jalundhwala.
Oriental Bank of Commerce inspite of not in a position to furnish all the documentary evidences in the proceedings before the court has given possession notice as if the entire property is owned by Span Medicals. This is illegal.
Jalundhwala has violated created charge on the immoveable property of Rupmangalam illegally as he has not been able to furnish any documentary evidence to judiciary that he had necessary authority and power to create charge.
Jalundhwala had illegaly filed criminal case in Navrangpura police station against Pankaj Mody without furnishing written confirmation and approval of the escrow persons consisting of Hemant Kashiparekh and Saurabh Soparkar with a view to cover up all his illegal acts of banking fraud with Global Trust Bank.

ANNEXURE B SECTIONS THAT MAY BE APPLICABLE

1. SECTION 196:- USING EVIDENCS KNOWN TO BE FALSE


* GTB has relied that Jalundhwala and Ameet desai are directors on the basis of Form 32 filed with ROC which shows that they are appointed as additional directors on 21-3-95 while deliberately ignoring the fact that they cannot claim to continue as director after the expiry of their term as additional director.

* GTB has ignored the fact after the expiry of additional directorship , jalundhwala ceases to be the director and therefore he does not have any power as so called director to accept so called alleged resignation of various mody family members.

* It is interesting to note that Dhanyushya , Jalundhwala and Core health care has not furnished such certificates in suit 5827/01 resignation of various mody family members.

* GTB was aware during the court proceedings that there was presence of escrow persons in Memorandum of understandings and it is simple logic to understand that they have not produced any written confirmation from the escrow persons that they have handed over various documents of ownership of Rupmanglam to Jalundhwala AND Dhanyushya Financial even after they became aware of the contents of letter dated 24-7-99 and 21-12-99.

S ection 196 is applicable to all the concerned management of Global Trust Bank.



2. SECTION 197 :- SIGNING FALSE CERTIFICATE:-


• JALUNDHWALA has signed false Form 32 (of resignation of directorship) when he has not produced all the evidences ( Filing of subsequent UNDER SECTION 302 TO ROC , auditor certificate , minute book records and confirmation from escrow persons) that he has been reappointed as director before he accepted so called alleged form of resignation , that is Form 32.

Section 197 is applicable to JATIN JALUNDHWALA BECAUSE HE HAD SIGNED FORM UNDER 302 OF ALLEGED RESIGNATION AS DIRECTOR


3. S. 209 . DISHONESTLY MAKING FALSE CLAIM IN COURT

· Jalundhwala AND DHANYUSHAYA MISREPRESENTED BY WAY OF DELIBERATE SILENCE THAT THEY RECEIVED DOCUMENTS OF ONWERSHIP FROM THE ESCROWS ESPECIALLY WHEN THEY HAVE NOT BEEN ABLE TO ADDUCE EVIDENCE TO THE BANK AT THE TIME OF CREATION OF CHARGE. The section is applicable to Jalundhwala and Dhanyushya and their directors.

4. S. 211 False chargeOF OFFENCE MADE with INTENT TO INJURE.

· CORE HEALTH CARE through kirit kanjaria has filed criminal defamation 3326/99 when he was not aware as to what transpired between Jalundhwala , Ameet desai and mody family concerning Rupmangalam as he was not present . This section is applicable to the directors of Core Health care such as Sushil Handa and other directors ,


5. SECTION 202:- intentional omission to give information of offence by person bound to inform :-

* OBC management has deliberately failed to give information of offence involving EGTB management as well as that of Jalundhwala and Core health care inspite of emails sent to them and has deliberately maintained silence even when they were legally bound to give after they received email intimation. The fact that the matter is subjudice does not give them right to conceal the information to the Economic offence wing. The section is applicable to the concerned management of Oriental Bank of Commerce.


6. SECTION 441 :- CRIMINAL TRESSPASS

* authority and power to create charge at the time of creation of charge and also in light of stay of government of Gujarat and also in light of original documents of deeds not deposited with the Talati at the time of creation of charge and they had failed to verify the authenticity of Span Medicals owning the entire property legally. OBC has attempted to take possession in light of possession notice to Core health care and Span Medicals on 31-1-05 without furnishing satisfactory documents that Jalundhwala had necessary. This section is applicable to the management of Oriental Bank of Commerce


7. section 120B :- CRIMINAL CONSPIRACY


* OBC management has conspired internally to accept the misrepresentation of jalundhwala , dhanyushya and Core healthcare for creation of charge in favour of Rupmanglam and that is the reason why they are remaining silent on the pretext that the matter is subjudice and are not answering emails sent to OBC to withhold illegal evidence and explanation . This is criminal conspiracy. The same was true for GTB management. The section is applicable to OBC management , GTB management along with Jatin Jalundhwala and other persons.

8. Section 467:- FORGERY OF VALUABLE SECURITY

* Bank and jalundwala in collusion with each other have misled and misrepresented the judiciary that the appointment of additional director on 21-3-95 signifies continuation of director ship of Jalundhwala to accept the alleged resignation of mody family under jalundhwala's signature (as director) vide Form 32 filed on 1- 10-1997. Besides the document Form under section 302 was filed on 1-10-97 with ROC shows that the name Jalundhwala was inserted underneath pankaj mody and so also the date of alleged resignation on 17-9-96 was inserted much later around September 1997 and not in September 1996. The section is applicable to various persons in charge of management of GTB , Jalundhwala ,etc.

9. S 409 CRIMINAL BREACH OF TRUST BY PUBLIC SERVANT, bankers ,:-

* Oriental bank of Commerce are not disclosing documentary evidence and satisfactory explanation inspite of sending emails to Oriental bank of Commerce management and they are remaining silent and stating that the matter is subjudice. They do not have any reason not to extend cooperation to the investigating agencies. The section is applicable to the concerned management of Oriental Bank of Commerce. S 406 is applicable to Jatin Jalundhwala.


11. S 411 DISHONESTLY RECEIVING STOLEN PROPERTY:-

* Oriental Bank of Commerce by issue of possession notice on Core Health care and Span Medicals has taken steps to grab the property using dishonest means even when they are not able to justify that Span Medicals is the owner of entire immoveable property when the escrows has not given written confirmation that they have parted ownership documents of Rupmangalam and Flovin., even when they are aware that Jalundhwala and GTB had no documentary evidence in Form 32 presented to ROC which confirmed that Jalundhwala continued after expiry of additional directorship term and Jalundhwala has not been able to produce that at the time of alleged resignation of mody family, jalundhwala had the authority to accept resignation of mody family members. The section is applicable to management of the bank on account of creation of charge of the property as well as on account of issuing possession notice.

12. S 420 CHEATING AND DISHONESTLY INDUCING DELIVERY OF PROPERTY

· Jalundhwala has cheated has misrepresented to the bank and fabricated documents to create illegal charge on immoveable property of Rupmangalam to induce the bank the take the delivery of the property even when he happened to be closely associated with the management of Core Health care as its employee.

· Sushil handa could have demanded the funds advanced to Technology Finance where Jatin Jalundhwala acted as director and as director of Technology Finance to give back the funds advanced Sushil Handa has cheated the share holders of Core health care by accepting creation of charge by jalundhwala on assets of rupmanglam on interest through Global Trust Bank even when interest free funds given by Core Health care .

The section is applicable to JATIN JALUNDHWALA AND DIRECTORS OF CORE HEALTH CARE WHICH INCLUDED SUSHIL HANDA.

In my earlier email annexed here with , I have referred some of the sections based on primae facie discussions with help of some advocates.

Unfortunately, I have dead line to comply in a court matter and obey the court directions by coming Monday and I have to personally attend the court matter in the court since last several days during court hours.

RESPECTED SIR,

Subject : Protection as well as investigation on GTB fraud connected with Jalundhwala and Core Health care.

I was referred by Shri Anil Pratham of Economic Offence Wing –Gandhinagar to give various sections that can be applicable to in the GTB fraud. The meeting had taken place on Monday -26 th June 2005 at Meghaninagar.

As there were heavy rains last week, I had difficulty in consulting some lawyers. They have referred that it would be necessary to have detailed investigation findings so that they can suggest various sections that can be applicable in the case.

On the basis of primae facie basis , following sections seems to be applicable 120 B , 420, 467, 477A and 13(2) r/a 13(1) (CP) of PC Act.

It appears that Economic Offence wing has has still to carry out detailed investigation pending precautionary steps of extending protection to the undersigned.

I would like to add that all the top executives of Oriental bank of Commerce inspite of emails to them have chosen to remain silent and not furnish detailed replies backed up by documentary evidences. This means that they are primae facie colluded with this group and are covering up the illegal acts of management of GTB for obvious reasons.

I am adducing recent press reports which shows CBI raids on Chairman of GTB –Ramesh Gelli (annexure A) , his linkage with ketan parekh (annexure B) and RBI filing case against Gelli (Annexure C) .

I am reproducing the press release on 3rd January 2005 which showed some of the sections applied by CBI. Here also the same sections of IPC have been referred and the same has been advised by some of my friends as referred in Para 3.Kindly refer Annexure D in this regard.

I do hope that necessary steps are taken on OBC obtain replies from them as regards to the email sent to them so that the Government of Gujarat can earn credit for exposure of vital and important bank scandal.

I do hope that the present information would suffice at the moment to take further urgent steps in investigation of banking fraud.

CBI field day: 31 public servants booked

NEW DELHI, JUNE 30 After raids at more than 180 places all over the country, the CBI today booked 31 public servants for undetected wealth to the tune of Rs 10 crore.
On the list of departments and organisations under the CBI scanner were Income Tax, Customs, Central Excise, BSNL, Narcotics Control Bureau, National Insurance Company Ltd, Ministry of Water Resources, Ministry of Information Technology and Communication, Delhi Development Authority, NCT Delhi, Delhi Police, Employees' Provident Fund Organisation, Bureau of Indian Standards, NALCO, RITES, PGI Chandigarh, State Bank of India, Railways, National Institute of Design, Industrial Financial Corp. of India (IFCI), Punjab National Bank, Dena Bank, Central Bank of India, the erstwhile Global Trust Bank and Hindustan Organic Chemicals Ltd.

Among those arrested were two superintendents of the Central Excise Anti-Evasion Cell, Kolkata—Maloy Bhattacharya and Debashish Bose.

A case has also been registered against Ramesh Gelli, former CMD of Hyderabad 's erstwhile Global Trust Bank Hyderabad , as also against six other directors and executive directors of the bank for cheating, criminal misappropriation and criminal conspiracy. It was alleged that the bank sanctioned Shonkh Technologies Ltd a loan-overdraft limit of Rs 40 crores as working capital, which was later misused.

A case of disproportionate assets has been registered against Parmatma Rai, DGM, BSNL, Gorakhpur. Preliminary recovery indicates investments in 12 plots in Varanasi, Greater Noida and Indore. The director (ME) of DGS&D, AK Aggarwal, has also been booked on a disproportionate assets charge.

Nexus between Parekh, promoter of GTB


DH News Service Bangalore : The Central Bureau of Investigation (CBI) found several "evidence of a nexus" between Ketan Parekh and the main promoter of Global Trust Bank (GTB), Ramesh Gelli during its raid in Bangalore on Thursday. The reported evidence of Parekh using his front companies to misuse banking channels and their accounts in GTB to carry out operations in the stock market were found by the CBI sleuths in Bangalore during their nationwide simultaneous raids in several offices in Hyderabad , Mumbai, Delhi and Bangalore .

Parekh, who then held five percent of GTB stock, allegedly carried out manipulative operations in the bank scrip using the FII broking house, Credit Suisse First Boston (CSFB) and other front companies. These front companies include, Chitrakoot Computers, Goldfish Computers, Nakshatra Software and Luminent Investments. The CBI has found several incriminating documents to the proof that an amount of Rs 32 crore was transferred to these front companies from the GTB branch on M G Road in Bangalore. These illegal transactions came to light after the GTB was amalgamated with OBC.

RBI hauls ex-GTB top execs to court

MUMBAI: This is one matter which continues to bug the Reserve Bank of India (RBI). The financial regulator has moved the court against the senior management of the erstwhile Global Trust Bank (GTB) for falsification and misstatement of accounts in '01-02 and '03.
The petition was admitted at the Mumbai Metropolitan Magistrate Court this week. The central bank is already waging war in court with the auditors of the private bank that was merged with the government owned Oriental Bank of Commerce in July '04.

Sudhakar Gande became the CEO of GTB after the RBI appointed managing director, RS Hugar, resigned in November '01. The RBI has alleged that the bank had violated the section 46(1) of the Banking Regulation Act in connection to submission of returns. Even in its inspection report on GTB for '01-02, RBI had pointed out huge gaps in the bank's provisioning figures.

The quantum of bad loans estimated by RBI were at unsustainable levels. RBI had subsequently hired the services of Bhaskar Rao & Co, a Hyderabad-based audit firm, to carry out a special audit of the bank.

After the messy break-up of GTB's merger with UTI Bank, GTB promoter Ramesh Gelli had stepped down from chairmanship in April '01. Following RBI directions, he later resigned as a director from the bank's board in June '01.

Even though the Joint Parliamentary Committee (JPC) which probed the Ketan Parekh scam virtually gave a clean chit to Mr Gelli, the central bank had already blacklisted him.

GTB has been under investigation for high exposure to capital market by way of advances against shares and guarantees, fluctuations in the prices of its shares and allegations of insider trading in the GTB scrip, and diversion of funds taken as loan from the bank by Ketan Parekh and others. The JPC report, however, said, "Prior to the announcement of the merger of GTB with UTI Bank, the promoters have not benefited as a result of price increase if any, either by sale of their holdings at higher share prices or beneficial swap ratio."

Following this there were even talks of Mr Gelli staging a possible come back. However, this never went down well with the regulator.

OBC FINDS SERIOUS FINANCIAL IMPROPRIETIES IN ERSTWHILE GTB

FILES CRIMINAL COMPLAINTS WITH CBI

Oriental Bank of Commerce (OBC) in its due diligence exercise after the amalgamation of the erstwhile Global Trust Bank Ltd. (EGTB) has come across cases of borrowal accounts where serious financial improprieties have been observed. Internal investigations have revealed that the Bank has taken high credit exposures in certain accounts even exceeding exposure norms prescribed by Reserve Bank of India . High degree of imprudence in exercise of sanctioning powers have been observed where the bank appears to have abetted certain group of borrowers to siphon off funds through banking channel. The conduct of most of these accounts reveal that deliberate attempts have been made to camouflage the position of NPAs by making fresh sanctions in sister/allied concerns including some front companies.


On the basis of internal investigation OBC has filed criminal complaints with the CBI in the following cases :


( i) In the case of M/s Unitel Software Ltd. for having caused wrongful loss to the tune of Rs. 676.79 lakhs to the bank in the matter of sanction, disbursal and utilization of the credit facilities. The CBI Mumbai has registered a regular case under Section 120-B read with Section 409 and 420 of the Indian Penal Code vide case No. 1/C/28/2004-BS&FC/LO.


(ii) In the case of Shri Ashok Advani of M/s. Business India Publications, Mumbai, the CBI has registered a regular case No. 1/C/33-2004/BS&FC/LO under Section 120-B read with Section 409 and 420 IPC against Shri Ashok Advani and unnamed officials of the bank for cheating the bank to the tune of Rs. 15 crores by obtaining credit facilities on the basis of misrepresentation. It was falsely mentioned in the process note that the account of M/s Business India was a new one, whereas Business India was banking with erstwhile GTB since 1994 and had defaulted in payment of credit facilities sanctioned earlier.


(iii) In the case of M/s Petro Energy Products Co. Ltd. (PEPCO), the Company cheated the erstwhile GTB to the tune of Rs. 78.41 crores at Bandra, Mumbai Branch and Rs. 23.15 crores at the Chennai Branch. CBI has registered a PE at Mumbai against M/s PEPCO and unnamed bank officials vide case No. 1/C/31/2004-BS&FC/LO.


(iv) In the case of M/s. Shonk Technologies International Ltd. (STIL), a wrongful loss to the tune of Rs. 38.49 crores was caused to the erstwhile GTB on the basis of misrepresentations and diversion the funds for purposes other than for which the loan was sanctioned. CBI has registered a PE vide case No.1/ C/30/2004-BS&FC/LO.


(v) In the case of M/s Pearl Distilleries Ltd., CBI has registered a complaint at Bangalore for having caused wrongful loss of Rs. 10.28 crores to the bank in the sanction and disbursal and utilization of credit facilities vide case No. 1/C/32/2004-BS&FC/LO.


Some other cases are also being examined and it is likely that OBC will lodge further complaints with CBI in due course.

I was referred by Mr. J M Chaudhary that , the office of Police Commissioner has been given instructions to arrange for protection during investigation but nothing has been done by them or Navrang pura police station. It appears they disregard the instructions given by the seniors of the Government of Gujarat. Now you would be able to appreciate that such lethargy and sloth from the office of the Police commissioner's office cause immense damage to me and my rights reulting in loss of possession of property as conveyed to them from time to time I fail to understand how come the Government of Gujarat tolerates such lethargy in the Police Commissioner's office which can tarnish the image of the seniors while affectng a person like me adversely and i am leading a life of vegetable in the state of Gujarat since last several years and there is no one in the Police department who wants to protect the dignity and respect of an educated person like me. while the crooks like sushil handa and the GTB bank go scot free. I n view of earlier emails to the Honorable Chief Minister of Gujarat, I humbly request you to hold the immoveable property in police custody pending further investigation on the banking fraud with GTB by Jalundhwala and Sushil Handa in collusion with GTB officials. For me raising and spending every rupee is becoming more and more difficult and there is no one to understand that it is extremely dificult to manage internet expenses and taking a print out copies . 1. This is in reference my earlier emails addressed to OBC FROM time to time for charge created by GTB for Rs 12.5 crore. You have failed to give satisfactory and transparent detailed reply to my emails deliberately. The earlier emails are adduced herewith. Kindly send fax to the branch located on CG Road in Ahmedabad immediately.

2. I would like to draw your attention that the next date for criminal defamation case 3326/99 is fixed on 15-06-2005 in the Metropolitan Court 22 at Meghaninagar. Kindly furnish detailed reply to the points referred in paragraph 5 of the present email show as to show your intentions and transparency in your dealings. Core Healthcare and Jatin Jalundhwala has failed to attend the Metropolitan court in December 2004 , March 2005 and April 2005 which shows that charge created by Jalundhwala was fraudulent.

3. In case , you fail to furnish details to the undersigned , then you are openly accepting that the creation of charge on Rupmanglam Investment Pvt Ltd property was done fraudulently and you have decided to encroaching on my rights of the immoveable property illegally and shamelessly with a deliberate intention to steal and grab the property and OBC management confirms that it is in collusion with management of GTB , Core Health Care and Sushil Handa and does not have any defence for the fraudulent acts.

4. Once again you are called upon to furnish a detailed reply to the present e mail as well as earlier emails to the undersigned while marking a copy of your detailed reply to the Gujarat High Court as well as Department of Banking Supervision simultaneously immediately on receipt of the present email but not later than evening of 7 th June 2005. The present email is being presented to the Judiciary as well as other crime investigating agencies.
